Terms of Service

1. The service

StayLuma applies corrective AI enhancements to listing photos you upload — for example lighting, colour, perspective and tidying of loose clutter. We follow an "enhance, don't fabricate" principle and do not add furniture, hide defects or invent views. Results are provided on an "as is" basis; we do not guarantee any particular outcome, ranking or number of bookings.

StayLuma is a finished-photo product: you upload an image and download the enhanced result. We do not provide API access, direct access to any underlying AI model, or resold AI/model credits — a credit simply entitles you to one finished, delivered photo of your own room.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. Authentication is provided through our processor Clerk. You are responsible for activity under your account and for keeping your credentials secure.

3. Your content & your warranties

• You own, or have all rights and permissions to, every photo you upload.
• You warrant that the enhanced photos still truthfully represent the actual property, and you will not use them to mislead guests or any platform.
• You will not upload unlawful content, content infringing third-party rights, or images of people without their consent.
• You remain solely responsible for how you publish and use the enhanced photos.

4. Licence to process your images

You grant StayLuma a limited, non-exclusive licence to host, process and transmit your images to our sub-processors solely to provide the service (see the Privacy Policy). We do not claim ownership of your photos and do not sell them.

5. Credits & payment

StayLuma is sold as prepaid credits. One credit equals one finished, delivered photo. Payments are processed by Creem, which acts as our Merchant of Record and reseller of the service.

A credit is debited only when an enhanced photo is successfully delivered. Failed jobs are not charged. Credits do not expire. Prices and pack sizes may change prospectively. Refunds are governed by our Refund & Cancellation Policy.

6. AI processing & provenance

Enhancements are produced using third-party AI infrastructure (currently Google Gemini for image edits and Anthropic Claude for quality review), used solely to process the photos you upload — not resold or exposed to you directly. Consistent with the EU AI Act, enhanced images are limited to standard corrective editing and may carry provenance signals or an "AI-enhanced" indication. You are responsible for any further disclosure required where you publish them.

7. Acceptable use

• Do not misuse the service, attempt to reverse engineer it, or disrupt its operation.
• Do not use StayLuma to create deceptive, fraudulent or non-compliant listings.
• We may suspend or terminate accounts that breach these Terms.

8. Disclaimers & limitation of liability

To the maximum extent permitted by law, the service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental or consequential damages. Our total liability is limited to the amount you paid to StayLuma in the 12 months before the event giving rise to the claim. Nothing limits liability that cannot be excluded by law, including your statutory consumer rights.

9. Indemnity

You agree to indemnify StayLuma against claims arising from your content, your use of the enhanced photos, or your breach of these Terms.

10. Changes, governing law & contact

We may update these Terms; material changes will be notified in-product or by email. These Terms are governed by the laws of France, without prejudice to mandatory consumer-protection rules of your country of residence. Questions: support@stayluma.net.
